1. Scope
The following general terms and conditions apply to all legal relationships between Carstensen Fries GbR (hereinafter also we or us), located at Kreuzburger Straße 4 in 90471 Nuremberg, and their counterparties.
2. Subject of the contract
2.1 Included services
In addition to the services described in the respective offer, a correction loop with a maximum workload of 3 hours is included. This means that the customer has the opportunity to express change requests after receiving the photos or videos. These will be incorporated free of charge in the above-mentioned period. An hourly rate of €150 will be charged for all changes beyond this.
This hourly rate is also due if the agreed working hours are exceeded for reasons for which we are not responsible.
2.2 Use Rights
With the complete fulfillment of the contractual obligations by both parties, the rights of use are transferred to the customer. Any use other than private requires written consent; this requirement also includes any transfer or delivery or other change in the rights of use. In principle, property rights are not transferred.
3. Terms of Payment
All prices include the applicable sales tax. This does not apply thanks to the small business regulation. The price depends on the individual offer or, alternatively, on the currently valid price lists, which can be found on the website.
When booking, a deposit of 30% of the total volume is due.
40% of the total price is due as the main payment 7 days before the start of the photo or video work.
The balance (final payment) is due immediately before receipt of the photos or videos. We will inform you of the appropriate time. After receipt of payment, the photos or videos will be handed over.
4. Liability and Warranty
Liability for negligence is excluded. This does not apply in the case of injury to life, body and health or in the case of gross negligence.
4.1 Complaints
If the customer has not made any complaints within seven days of receiving the photos or videos, they are deemed to be free of defects and in accordance with the contract.
4.2 Corona reservation
If any corona regulations that endanger us or our work are not observed during the photo or film work, we reserve the right to cancel them. The agreed fee, in particular the final payment, remains to be paid.
5. Liability
5.1 Changes
Changes to the booking are generally not possible.
This applies in particular to the date of the shoot. Changes to the booked service are also not possible if a shorter or lower-quality service is subsequently requested.
5.2 Top-Ups
If the booked number of hours is extended (at short notice), a corresponding surcharge will apply. This corresponds to the on-site hourly rate of the booked offer. As soon as the price of the next higher offer is reached, the price of this higher offer applies. All hours that go beyond the next largest offer are calculated from its price.
For example:
Booked offer: 6 hours of videography for € 4,500
On-site hourly rate: €4,500 / 6 = €750 per hour
If the booked offer is increased by, for example, one hour, the total will be €4,500 + €750 per hour = €5,250.
If the booked offer is increased by, for example, six hours, the price of the next largest offer will be charged, in this case € 6,000 for the 12-hour offer.

5.3 Cancellations
In the event of cancellations or cancellations up to 90 days before the wedding, the main and final payment will be waived, up to 14 days before the wedding a total of 50% will be due. In the event of cancellations or cancellations on the day before or on the day of the wedding, we will waive the final payment.
6. Validity and Place of Jurisdiction
6.1 Legal Effect
The invalidity of individual provisions of these general terms and conditions does not affect the validity of other provisions contained here. We reserve the right to make changes.
6.3 Jurisdiction
In the event that the customer does not have a place of jurisdiction in the Federal Republic of Germany or relocates his registered office or habitual residence abroad after the conclusion of the contract, the place of jurisdiction of the author of the picture is agreed as the place of jurisdiction.
